Former Minister and Member of Parliament of the Samagi Jana Balawegaya, Attorney-at-Law Sujeewa Senasinghe, has found himself embroiled in a legal battle that has now reached the Supreme Court. The court has granted leave to proceed. for the fundamental rights petition filed by Senasinghe, challenging an unlawful investigation by the Criminal Investigation Department (CID), led by the Secret Police. The petition calls for a ruling that his fundamental rights were violated in relation to an investigation based on unfounded allegations.
The petition, which is being heard by a three-member bench of Justices Kumuduni Vikramasinghe, Janak de Silva, and Sampath Abeykoon, names several prominent figures as respondents, including the Inspector General of Police, the Deputy Inspector General of the CID, and the Attorney General, among others. Senasinghe’s legal team, led by President’s Counsel Ali Sabri, argued that the investigation was based on false information presented by the CID about a vehicle allegedly involved in illegal activities.
Cleared of Wrongdoing
According to Sabri, the vehicle in question had been properly registered in 2022 and was legally used under a garage number, making the police's claims unfounded and the investigation unjust.Sabri further emphasized that an initial investigation by the Anti-Corruption Unit had already cleared the vehicle of any wrongdoing. Despite this, the CID continued their investigation based on false allegations, causing significant distress to Senasinghe and violating his basic human rights.
In light of these events, Sabri is seeking a court ruling to halt the investigation and restore his client’s rights.On the opposing side, Additional Solicitor General Mrs. Warunika Hettihewa, representing the respondents, defended the CID’s actions, claiming that all necessary legal procedures had been followed, including obtaining search warrants and conducting the investigation in accordance with the law.
