Chief magistrate Emma Arbuthnot in her judgement said that, "I have no doubt about the gesture he employed of cutting the neck on February 4th, 218". Prior to this, on an earlier instance though summons was served for the brigadier to be arrested, as a result of a blunder between British foreign ministry and magistrate court staff, the judicial summons was invalidated. Subsequently chief magistrate of magistrate court Mrs. Emma Arbuthnot decided to call the case right from the start, taking the case into her hands. This case was put off on several occasions. In the same way during the course of evidence being heard, a protest was launched by Eelam supporters and Tiger supporters outside court premises.
