The one million fine for Vimal, who lost the case filed by Tilvin, is confirmed.

The Supreme Court today completely dismissed an appeal petition filed by former Minister Wimal Weerawansa. This appeal was filed against a decision by the Colombo Commercial High Court, which had ruled that the publication of the book titled "Naththa Venwata Aththa" (Truth Instead of Lies) had violated the Intellectual Property Act.

Accordingly, the Supreme Court affirmed the previous order issued by the Commercial High Court, directing former Minister Wimal Weerawansa to pay one million rupees as compensatory damages to Mr. Tilvin Silva, the General Secretary of the Janatha Vimukthi Peramuna (JVP).




With this verdict, the Supreme Court also imposed a special injunction order on the former minister. Accordingly, the printing, distribution, or sale of documents related to the Janatha Vimukthi Peramuna included in the said work is completely prohibited henceforth, and the respondent has been informed not to engage in any act that violates intellectual property rights.

This legal action began with a case filed by Mr. Tilvin Silva before the Colombo Commercial High Court. He accused Mr. Wimal Weerawansa of unauthorizedly including ideas and proposals he had presented to the party's executive committee while he was a member of the Janatha Vimukthi Peramuna, in his (Weerawansa's) work. Complainant Mr. Tilvin Silva had pointed out to the court that his intellectual property rights had been violated thereby.




Following a lengthy trial, the Colombo Commercial High Court, in its verdict announced on January 11, 2019, stated that the true ownership of the relevant sections contained in the book "Naththa Venwata Aththa" should belong to Mr. Tilvin Silva. The final decision on the appeal filed against that High Court order was announced today by Supreme Court Justice Sobitha Rajakaruna.
