What the Speaker Mr. Chamal Rajapaksa mentioned today on
announcing the decision on the 19th Amendment of the government constitution by the Supreme Court was that since some clauses in it were of a serious nature, if any amendments/modifications are to be carried out, a referendum is warranted.

42 (3), 43 (1), 43 (3), (44) 2, 44 (3), 44 (5) of Clause 11  and sub-amendments and 104 (b ) and 5 (d) of sub-Clauses.

They are shown in detail below.

Prime Minister Ranil Wickremasingha has agreed today that he is agreeable for those sections  to be removed and for the 19th Amendment be adopted. The clauses to be removed are shown below:

Clause 11
42 (3), The Prime Minister will be the Head of the Cabinet of Ministers.

43. (1)
The Prime Minister shall determine the number of Ministers in the Cabinet of Ministers and the Ministries and the assignment of such subjects and functions to such Ministers.

43. (3)
The Prime Minister may at any time change the assignment subjects and functions and recommend to the President, changes in the composition of the Cabinet Ministers and the continuity of the Cabinet of Ministers and the continuity of its responsibility to parliament.

44 (2)
The Prime Minister shall determine the subjects and functions which are to be assigned to Ministers appointed under Paragraph (1) of this Article and the Ministers, if any, which are to be in charge of such Ministries.

44 (3)
The Prime Minister may at any time change any assignment made, under Paragraph (2).

44 (5)
At the request of the Prime Minister, any Minister of the Cabinet of Ministers may by notification published in the gazette, delegate to any Minister who is not a member of the Cabinet of Ministers, any power or duty pertaining to any subject or function assigned to such Cabinet Minister or any power or duty conferred or imposed on him or her by any written law and it shall be lawful for such other Minister to exercise and perform any power or duty delegated notwithstanding anything to the contrary in the written law by which that power or duty is conferred or imposed on such Minister of the Cabinet of Ministers.

Clause 26
104 (b)
When the commission has the powers to issue a prohibition order in writing by the chairman of the commission or the Elections Commissioner under the instructions of the commission any immoveable or moveable property by the State or State Corporation, it will be the duty of  the person or every officer in charge of that property or in control of that property to accede to that order and to act in accordance.

5 (c)
In the instance when the Sri Lanka Radio Corporation or Si Lanka Rupavahini Corporation or Independent Rupavahini Channel or other Rupavahini or radio enterprise or private radio or rupavahini service being conducted is violated can be appointed by name or office by a competent authority or commission. The powers vested in the competent authority and the functons shall be adopted by law by the parliament.
