The former Chief Justice, Sarath N Silva points out that Sarath Fonseka has not been totally freed by the President Mahinda Rajapakse. He had released him by pardoning only
He also points out that Sarath Fonseka is deprived of his community rights for another 7 years since he was released before by the court marshal.
In an interview to ‘Divaina’ he has expressed his views as below:
“If the President is pardoning a prisoner that should be as the leader of the state and not as an act in the political agenda. There were two cases against Fonseka. Those were the Hicorp/ white flag case and the other was from the court marshal. President has pardoned Fonseka from the white flag case, yet he has not been released from the court marshal.
Since he has not been released from that case, he will be deprived of community rights for another 7 years. It shows that two issues have arisen due to one fact.
Thus he has been made an outside prisoner and this has been done very shrewdly. If he is released from the other case as well, he will have the privilege of enjoying the community rights.
When the President has pardoned Sarath Fonseka by using his executive powers from his office held as a President, he has also used them in such way that would deprive his political opponent’s political rights.
At the same time there is no way to take actions about the deprivation of human rights of Sarath Fonseka from the time he was arrested. The President too had accepted that Fonseka has faced injustice. That injustice is revealed from the freedom given to Fonseka.”
