The Colombo Fort Magistrate's Court today ordered Mr. Suresh Salley, former Director of the State Intelligence Service and a retired Major General, to provide the sealed passwords of his laptop and mobile phone, which were taken into custody by the Criminal Investigation Department (CID) when he was arrested, to the investigating officers. In addition, the court completely rejected the request to remove Mr. Shani Abeysekera, Director of the Criminal Investigation Department, from the investigations related to this incident.
The trial was held before Colombo Fort Magistrate Mr. Pasan Amarasena, where Additional Solicitor General Mr. Dilip Peiris stated that these electronic devices were found inside the suspect's vehicle at the time of his arrest. The prosecution revealed to the court that before the investigating officers took them into custody, Mr. Suresh Salley had attempted to leave the laptop in his office, claiming it belonged to his daughter. It was also stated that the suspect had deliberately refused to provide the essential passwords required to access these devices.
Since the suspect, Mr. Suresh Salley, is a skilled hacker who has received special training to gain unauthorized access to computer systems, Mr. Dilip Peiris requested the court to issue an order to the investigating officers to obtain the passwords he possesses to successfully complete the current investigations. However, President's Counsel Mr. Shavendra Fernando, appearing for Mr. Suresh Salley, strongly objected, stating that a Magistrate's Court has no legal authority to issue such an order.
Magistrate Mr. Pasan Amarasena, after considering the arguments of both parties, ruled that in accordance with Section 124 of the Code of Criminal Procedure Act, the court has full legal authority to issue necessary orders to facilitate criminal investigations. Accordingly, the former intelligence chief was ordered to immediately provide the passwords of the relevant devices to the Criminal Investigation Department.
Meanwhile, rejecting the request to remove Mr. Shani Abeysekera from this investigation, the Magistrate issued a lengthy 23-page order. Through this, requests to provide writing materials to Mr. Suresh Salley and to allow him to make a confidential statement were also rejected by the court. The Magistrate, who decided to postpone the case until September 2nd, also ordered the suspect to be produced before the court via video link on that day.
