The Joint Opposition has currently decided to seek the Supreme Court's intervention against the government if it takes steps to establish a 'Dharmadhikaranaya' (Religious Court).
This decision was made at a meeting of the Joint Opposition's party leaders, chaired by former President Ranil Wickremesinghe. During the meeting, the former President advised party leaders to immediately approach the Supreme Court to investigate the legality of establishing a new 'Dharmadhikaranaya' (Religious Court) and whether the process aligns with the current constitution. Political sources reveal that this step is being prepared due to the disadvantage the opposition would face if the monks, who are currently leveling various accusations against the government, are suppressed through this.
Ranil Wickremesinghe pointed out that the country's constitution only provides for the establishment of a 'Sanghadhikaranaya' (Monastic Court). Accordingly, he stated that if an attempt is made to establish a 'Dharmadhikaranaya' (Religious Court) outside of this provision, they could go to the Supreme Court against it. He further recalled that President's Counsel Wijeyadasa Rajapakshe had previously prepared and submitted a draft bill related to the establishment of a 'Sanghadhikaranaya' to Parliament.
Mr. Wickremesinghe also stated that the monks of the Karaka Sangha Sabhas (Executive Monastic Councils) have not made any statement indicating the need for a 'Dharmadhikaranaya' (Religious Court) based on the incident involving Venerable Pallegama Hemarathana Nayaka Thero. Furthermore, they have not yet commented on the disciplinary matters related to the said incident. The former President emphasized at the party leaders' meeting that even foreign nationals who ruled this country in the past had deeply studied Buddhist philosophy when formulating laws.
Meanwhile, Mr. Wickremesinghe has informed the party leaders that legal action should also be taken against the state officials who contributed to preparing a concept paper for the creation of a 'Dharmadhikaranaya' (Religious Court). Additionally, the opposition party leaders who attended this meeting have expressed their strong protest against the steps taken to remove Venerable Pallegama Hemarathana Thero from his positions without any official charge sheet or presentation.
