Even though Fonseka will be released he cannot contest for an election as a candidate for another 7 years:
He cannot compete for the next Presidential election as a candidate as well:
On one hand when the rumours of Sarath Fonseka were being released, the main topic of discussion, at the same time, people were talking as to what he will do once he is released. According what the officials in the legal system points put, even though Sarath Fonseka is released from the jail he will have many obstacles and limits on his political career.
The lawyers, Udaya Gammanpila and Prathibha Mahanahewa have made a statement to the media about two aspects on which he will be limited:
Accordingly, a person who had been under a sentence of 2 years and a person who had been in jail for at least 6 months out of that cannot compete in an election for another 7 years.
The second one is that his community right will be rejected. There, he cannot indulge in politics or compete for an election candidature. Sirimawo Bandaranaike, S.B Dissanayake, Rohana Wijeweera too had to stay away from politics since their civil rights were banned. Yet they joined politics after they were pardoned. But Fonseka hadn’t been banned of his community rights.
Here he can join political meetings, make speeches on the political stages and he can support any political party. Yet, he cannot compete for an election as a candidate.
However, that depends on the decision of the President because if the President pardons him conditionally, then he will be in house imprisonment and he will not be able to compete for an election. According to what is being reported he will be granted release unconditionally.
Now, the problem is about the time limit.
Since the announcement of Sarath Fonseka has not yet been made, his plans after he is released cannot be decided now itself. It is reported that he will be released within the course of this week.
If we consider the date of his imprisonment, which was in February in 2010 then, he will be able to compete for an election only in 2017.If we consider he date he will be released, which will be May of 2012, then he can compete for an election as a candidate only in May of 2019.
However, looking at those two options, it seems that he cannot compete for the next election which will be held in 2015 or 2016.
