Story about Mahinda Deshapriya going to courts ... by saying decision is wrong.
Some reports have been published that Chairman of Election Commission, Mr. Mahinda Deshapriya that he would be going to Supreme Court saying that dissolution of parliament is contrary to the constitution. However, he has still not made an official announcement in that connection as such.
According to the 19th amendment the President has powers to dissolve parliament only after parliament has completed its period of four and a half years; as such, the act of dissolution should be
effected only in the month of March, 2020. If not, it is stated in the amended constitution that a dissolution could be effected only in the instance of a defeat of the budget or with a 2/3rd majority in parliament.
However, what former chief justice Mr. Sarath N. Silva has said is that in the case when a parliamentary session has been suspended ... such an article does not come into force. During the period when the post of Elections Commissioner was active, he was to carry out orders of the President; but after Mr. Mahinda Deshapriya was appointed as Chairman of Independent Election Commission by this government, his designation as well as his powers were automatically abolished. He thus has the opportunity of questioning an order imposed on him. Whatever it is, such an official announcement has still not been released.
