Gotabhaya can't be taken into custody ....

without investigations

Supreme Court informs

Former Secretary of Defence forwarded a petition to Supreme
Courts subjecting the Police Financial Crimes Investigation Division throwing a challenging about their legality saying that this illegal Unit is preparing to carry out an imminent arrest on him and that it should be prevented.

The Supreme Court which took into consideration this petition of fundamental rights though did not take steps to prevent that hearing however issued an interim order preventing his arrest until the inquiry is over. Of the three member Bench of Judges appointed, Mr. Buvaneka Aluvihare had stepped down but had not given reasons for doing so. On his withdrawing from the Bench the case was heard by the Bench of Judges comprising judges Eva Wanasundera and Sarath de Abrew.

Under these circumstances the petition would be called for hearing on October 6th which is in about another 5 months; but activities of the Police Financial Crimes  Investigation Division is not hindered by this decision.
