WHITE FLAG JUDGEMENT: FONSEKA’S JAIL TERM EXTENDED

The Senior Attorney, Nalin Laduwahetty said against the verdict given at trial-at Bar in the former Army Commander’s “White Flag Case’, an appeal would be filed against the verdict with a view to change the decision already given.

Only Judge T.B.Warawewa gave verdict in Fonseka’s favour:
The High court comprising of a three benched Judges comprising of Deepali Wijesundera (Chairperson),A.Z.Razack and W.M.T.B.Warawewa were to deliver the judgement in the white flag case against the former Army commander Sarath Fonseka. Only Judge Warawewa gave his verdict in favour of Sarath Fonseka. But the other two verdicts were against Sarath Fonseka.
Some of Sarath Fonseka’s supporters who never expected this verdict were in hundreds hurled stones and other objects in dejection. The Police was however was able to bring the situation under control.
FONSEKA HAD TO BE DRAGGED:
After the verdict of the white flag was delivered it was difficult to take out Sarath Fonseka from the front door as it was his supporters who invaded the place by his protestors. Hence the Prison officers took him through the back door saying that ‘finger prints’ had to be obtained, it is reported.

THREE YEARS JAIL SENTENCE FOR SARATH FONSEKA:
The white Flag case against former Army Commander Sarath Fonseka was heard over a period of one year. The verdict was delivered today. According to the verdict it was by a proportion 2/3, that Fonseka was found guilty and accordingly was sentenced to jail for a period of three years and a fine of rs 5000/- was imposed. If he failed to pay the fine the sentence imposed would be extended by a further period of 6 months.
Expecting clashes between the Fonseka supporters and the opposing factions the Keselwatta Police had decided to announce that area as a high security area from yesterday (the 17th) .But against this ruling the Colombo’s Magistrate had declined their decision and had ordered to be prepared to maintain law and order in the case of any eventuality and to abide by the law.
FEDERICA FLEES TO AUSTRALIA:
The chief witness of this case journalist Federica Jansz had fled yesterday to Australia and had not been in courts at the time the verdict was given. She had said earlier that she had received death threats earlier. However she was highlighted for giving contrasting statements during the previous hearings.
THERE ARE THREE ACCUSATIONS MADE: 
The former Army commander was made the defendant by the Attorney General on three charges. They were heard over period of over one year by a bench comprising of three Judges. When the lawyers and Judges made counter accusations, former Army Commander, Sarath Fonseka had made a number of oral views. 
During the latter stages of the war the former Army Commander had made a statement that the Defence Secretary Gotabhaya Rajapaksa and Brigadier Shavindra Silva had ordered to shoot those who came to surrender with white flags.
For over a one year period 23 persons were made to come to courts to air their views to give evidence. The case was first called up on the 27th September 2010. Altogether 15 persons were summoned on behalf of the Plaintiff’s party and 8 persons as witnesses to obtain statements. Sarath Fonseka was on 6 times questioned from the witness’s box. The case was heard on 57 days and ended only on the 18th October 2011.The verdict was to be delivered on the 18th November 2011,  30 days later it was to be announced.
