Pilot's appeal against refusal to take Chamika's DNA

The complainant pilot has filed an appeal before the Colombo Civil Appellate High Court against the Colombo District Court's rejection of the request to order a blood sample from Sri Lankan cricketer Chamika Karunaratne for a DNA test.




This complainant, named Rasika Sewwandi, filed the case before the Colombo District Court with the aim of obtaining an order from the Registrar General to issue a birth certificate stating that Chamika Karunaratne is the father of her child. Given this crisis regarding the child's paternity, she also requested the court to order a blood sample from the said player for a DNA analysis to confirm paternity.

However, stating that the complainant party failed to present sufficient or reasonable grounds to grant the requested relief and to obtain a blood sample for a DNA test, Colombo District Judge Mr. Lalith Kannangara took steps to completely dismiss the request on August 4th.




During the relevant court session, President's Counsel Wijeyadasa Rajapakshe appeared for the complainant Rasika Sewwandi, while President's Counsel Jagath Wickramanayake and Nirmala Gunathilaka appeared for Chamika Karunaratne, on the instructions of Ramsy Bacha Associates.

Although the DNA test request was rejected, the court has ordered the case, which is pending in the District Court, to be called again on October 9th for further proceedings.
