For taking a person into custody by a misjudging a name,CID made to pay a fine
A fundamental rights case had been filed by a person who had been arrested by the officers of the criminal investigating unit for arresting and questioning him by mistaking him to another person with similar initials.This person after arrest had repeatedly denied of an offence
committed by him.
It is reported that the officers of the criminal investigating unit had been ordered to pay a sum of rupees three lakhs to this person after the case was lost by them.
The incident had taken place in the year 2010.For detaining him and questioning his fundamental rights have been violated.This had been said to the Supreme court by a resident of Himbutane,Angoda Omantha Mudalige Don Gamini a businessman.The respondents to this petion had been the Inpector of Police Nishantha Silva,police Sergeant Mendis( 14209) and Sub Inspector Ranjith Munasinghe.
The Judges of the Supreme courts had said that arresting him and questioning had been incorrect.With the verdict a sum of rupees three lakhs had been ordered to be paid to the innocent victim
