information published regarding Kondaya

- Gampaha Chief Magistrate

Even though the episode concerning the person known as Saman Jayalath in connection with the rape and murder of Seya Sandewmi of Kotadeniyawa recently came towards the final phase with the compatibility of the DNA, the dialogue in relation to the violation of
Fundamental Rights of several individuals which has been reported across the media over this incident is still not over.

Though the Gampaha Chief Magistrate Mr. Tikiri K. Jayatilleka had ordered yesterday (21) that Kondaya who was warranted by courts be released on 2 personal bonds of Rs. 50,000 nobody came forward to stand for the bond and thus Kondaya had once more to go back to jail.

After it was announced at Gampaha Courts that the suspect was assaulted by officers of the Criminal Investigation Department, the Minuwangoda Magistrate filed a motion and informed the Magistrate to conduct an investigation on it. In the meantime, the Magistrate had expressed matters concerning Kondaya becoming a wrongdoer in society and that was even before he was convicted as guilty by courts. "Whoever is taken into custody is considered a suspect until his accusations are proved. A case is investigated under the Act of Evidence. The police has no right to mention that a suspect is a criminal or offender. Reporters have a right to write. The Police Media Spokesman is responsible for the information published in relation to the suspect", he had said. It was Mr. Priyantha Jayakody the Senior Police Superintendent who was on duty as the Acting Police Media Spokesman during the Seya Sandewmi murder case.
